A. General

  1. The website body-soul.me (the "Website") is a content website intended to provide information to people coping with chronic pain that does not stem from a clear structural or physical source. Among other things, the Website presents current information based on contemporary research and professional literature in the field, regarding pain mechanisms and treatment approaches shown to be effective, all subject to the terms set out in these Terms of Use.
  2. The Website is managed and operated by Yotam Yanai, a licensed physiotherapist (B.PT) with extensive experience in rehabilitative physiotherapy and a specialization in the treatment of chronic pain (further details on the "About" page) (the "Website Owner").
  3. These Terms of Use constitute a binding legal agreement between the Website Owner, or anyone acting on his behalf, and any user who uses the Website, and are intended to govern the relationship between them with respect to browsing and use of the Website's services. The agreement applies to any use of the Website, whether directly or indirectly, whether in Israel or abroad, whether via the internet or by any other means of communication.
  4. Browsing or using the Website constitutes full acceptance of all the provisions of these Terms of Use. A user who does not agree to the terms is requested to refrain from browsing or using the Website.
  5. This introduction forms an integral part of these Terms of Use.
  6. The Website Owner may update and amend these Terms of Use from time to time, at his sole discretion, and it is the user's responsibility to review the updated version on each visit to the Website.
  7. Wording in these Terms of Use in any gender refers to all genders, and wording in the singular includes the plural, and vice versa.

B. Use of Website Content

  1. The Website's content is provided for general information and informational purposes only. Any use a user makes of the Website or its content is at that user's full and sole responsibility, and the user irrevocably releases the Website Owner and anyone acting on his behalf from any liability for such use and for any damage, financial or otherwise, that may result from it.
  2. The Website's content does not constitute any personal advice, whether medical, psychological or other, and does not constitute an undertaking or guarantee by the Website Owner of any particular therapeutic outcome. In particular, the content is not a substitute for personal diagnosis and consultation with a professional. To obtain personal advice, please consult a licensed professional in the relevant health field.
  3. Use of or browsing the Website does not create any practitioner-patient, physician-patient, psychotherapist-patient or any other professional relationship between the Website Owner and users.
  4. The Website Owner and anyone acting on his behalf shall not be liable for any damage, whether financial, physical, psychological or otherwise, caused to a user or to any third party as a result of reliance on the Website or its content, whether directly or indirectly.
  5. The Website Owner may, at his sole discretion and without prior notice, discontinue the operation of the Website, whether temporarily or permanently, including for purposes of maintenance, reorganization or any other reason related to its operation. Such actions shall not give rise to any cause of action or claim against the Website Owner.
  6. The Website Owner makes reasonable efforts to ensure that the information on the Website is accurate and up to date. However, scientific and research-based information is by nature a dynamic and evolving field, and therefore certain content on the Website may not be current, complete or exhaustive. For this reason as well, the Website's content should not be relied upon, and in particular not for personal health decisions.

C. Intellectual Property

  1. The Website includes original content (including its design and various components) in which the Website Owner holds the intellectual property rights, alongside content that the Website Owner is authorized to use or whose use is made in accordance with the law.
  2. Unless otherwise stated, all intellectual property rights in the Website, including copyrights, distribution rights, trade secrets, trademarks and any other proprietary right, in all content on the Website, including text, images, videos and any other content, belong exclusively to the Website Owner and are protected by law.
  3. The content of the Website, or any information from it, may not be copied, reproduced, distributed, published or used in any way without the express written consent of the Website Owner.
  4. The Website and its content are intended for the private use of users only. No commercial use may be made of the Website or its content, whether for consideration or otherwise, without the prior written consent of the Website Owner. This includes a prohibition on publishing the Website's content in any electronic, commercial or printed form without such consent.
  5. To the extent that the Website contains links to other websites or pages not owned by the Website Owner, these are provided for general information only. The Website Owner is not responsible for their integrity, reliability, legality or content. Access to such websites is at the user's sole responsibility, and the user shall have no claim against the Website Owner regarding any damage caused by using or browsing them.

D. Privacy and Confidentiality

  1. A user who contacts the Website Owner and voluntarily provides personal details, whether through the Website's contact form, by email, by telephone or by any other means, shall be deemed to have consented to the Website Owner retaining those details for the purpose of responding to the inquiry. The Website Owner will not use those details beyond the purpose of the inquiry without the user's consent.
  2. The Website Owner will use his best efforts to maintain the confidentiality of the details provided to him. However, he cannot absolutely prevent unauthorized intrusion, and therefore the user waives in advance any claim against the Website Owner in this regard, provided that the Website Owner has taken reasonable measures to prevent such intrusion.

E. Lawful Use and Indemnification

  1. The user undertakes to use the Website lawfully only, in accordance with these Terms of Use and with all applicable law. A user who breaches these provisions shall fully indemnify the Website Owner, immediately upon his first demand, for any damage caused as a result of the breach, including legal expenses, and for any demand or claim directed at the Website Owner by a third party in connection therewith.
  2. The Website Owner may, but is not obligated to, take any lawful measure available to him against a user who breaches the provisions of the law or these Terms of Use, including blocking the user from further use of the Website.

F. Governing Law and Jurisdiction

  1. Any use of the Website, and any dispute that arises between the user and the Website Owner or anyone acting on his behalf, shall be governed solely by Israeli law. Exclusive jurisdiction over any such matter is vested in the competent court in the Haifa District, Israel.

H. Language

  1. These Terms of Use are drafted in both Hebrew and English. In the event of any conflict or inconsistency between the versions, the Hebrew version shall prevail.
